Lawsuit blames East Palestine train derailment for 7 fatalities


A new lawsuit filed in the Franklin County Court of Common Pleas in Columbus alleges that at least seven people have died from the aftermath of the 2023 Norfolk Southern train derailment in East Palestine. The lawsuit involves 744 current and former residents from the area and was filed on the second anniversary of the disaster. The freight train was carrying hazardous materials, including a toxic, flammable gas called vinyl chloride. The derailment led to residents being uprooted from their homes, environmental cleanup efforts, and concerns about long-term health effects. Vice President JD Vance and other Republican leaders visited the site to mark the anniversary.

The lawsuit claims that Norfolk Southern, the EPA, CDC, state and county agencies, and other corporations involved in the crash, investigation, and cleanup are responsible for the deaths and damages caused by the derailment. The lead plaintiff, Josh Hickman, demanded answers and accountability for the community.

The lawsuit alleges that the deaths of Margie Mae Lewis, Margo Zuch, Randy Swogger, John R. Moore, Viola Noel, Edward Zins, and newborn Carlyn Tigelman were a result of the derailment. Several federal lawsuits have also been filed against Norfolk Southern over the incident. The lawsuit accuses Norfolk Southern of influencing Ohio state officials with contributions. The lead attorneys for the families are from law firms based in Ohio, Florida, and Texas. The families involved in the lawsuit claim they have not been told the full story and have been left with unanswered questions and health consequences.
