Michigan Supreme Court rejects officer’s appeal in Lyoya case


The Michigan Supreme Court declined to hear an appeal from former police officer Christopher Schurr, who is facing a second-degree murder charge for the fatal shooting of Patrick Lyoya during a traffic stop in Grand Rapids in April 2022. Schurr argued he was acting within his rights as a law enforcement officer. The Court of Appeals upheld the decision to bind Schurr over for trial, leading to the Supreme Court’s refusal to hear the case.

Schurr, who was fired from the Grand Rapids Police Department after being charged, had attempted to use a stun gun on Lyoya during a struggle before ultimately shooting him in the back of the head. Prosecutors have argued that a jury should decide whether the use of lethal force was justified. The shooting led to protests and increased calls for accountability within the Grand Rapids Police Department.

Since the incident, the Grand Rapids Police Department has implemented new policies, including de-escalation training and a policy dedicated to the “sanctity of life.” A trial date for Schurr has not been set, but Kent County Prosecutor Chris Becker stated that they hope to reach a resolution for Lyoya’s family soon. Schurr’s defense attorney did not provide comment, and the case will now proceed towards trial without further appeal.
