The judge ordered Musk to attend the hearing along with representatives from the PAC. The lawsuit argues that the lottery is deceptive as the rules have not been clearly published, and the selection of winners may not be random as claimed by Musk.
Krasner’s lawyers also raised concern over the safety of the hearing, requesting enhanced security due to the sharing of personal information about the prosecutor online. Musk and his attorneys have not yet responded to the lawsuit.
The court hearing has been moved up to Thursday morning to address the issue. Musk’s actions are under scrutiny as he faces allegations of illegal influence on voters in a critical swing state.
