Watchdog asserts Navy secretary violated law with political statements about presidential race


Navy Secretary Carlos Del Toro has been accused of violating the Hatch Act by endorsing President Joe Biden’s reelection and criticizing former President Donald Trump while on official duty overseas. The U.S. Office of Special Counsel found that Del Toro’s comments crossed a legal line, as they constituted engaging in political activity while on duty. In response to questions after a speech in London and during a BBC interview, Del Toro expressed support for Biden and criticized Trump’s democratic principles. Despite later reporting the remarks, Del Toro’s unwillingness to take responsibility for them is troubling, according to the special counsel. Del Toro’s lawyer argued that the comments were spontaneous and did not directly name Trump, but the special counsel found that a violation had occurred.
The Department of Defense is reviewing the report, and Navy Capt. Clay Doss stated that the matter will be addressed through the appropriate process. Del Toro has issued a directive emphasizing the apolitical nature of the Department of the Navy. The findings follow a letter from two Democratic members of Congress urging the military to avoid being involved in politics during the presidential election. Violations of the Hatch Act can result in penalties such as suspension or demotion, though few are ever imposed. The White House has not yet commented on the report.
